Work and Stay Permit

A PMA and local company may employ expatriates. There is, however, a list of positions issued by the Ministry of Manpower that cannot be assumed by expatriates. As a general rule, an expatriate cannot assume a position that handles a human resources matter. Expatriates working in Indonesia must obtain a working and stay permit. Indonesian Manpower Law also requires the employer to employ Indonesian employees to act as a counterpart for each expatriate employee as a prerequisite to grant a work permit for an expatriate employee. In general, the Ministry of Manpower and Transmigration will require a minimum one to three Indonesian counterparts for each expatriate.

  1. Have written permission from the manpower minister or officer appointed;
  2. Appoint Indonesia staff as assistants for transfer of technology and skill transfer (not applicable  for the position of Directors and Commissioners;
  3. Implement education and job training for the Indonesian staff in accordance with the qualification positions occupied by foreign workers;
  4. Pay compensation for any foreign workers employed;
  5. Repatriate foreign workers to their countries after the employment relationship ends.

LICENSING PROCESS CHART OF USE FOREIGN WORKER IN INDONESIA

 

REQUIREMENTS FOR EXPATRIATE WORK & STAY PERMIT
  1. PERSONAL (WORKER):
  2. Record of valid passport for at least 18 months in full page (whole book);
  3. Record of education certificate (most recent qualification is sufficient);
  4. Record of job experience (work experience) in English or translation into Indonesia language (from previous company);
  5. Record of polish Insurance to be attached for the IMTA ( work permit application)
  6. The current curriculum vitae signed by the expatriate concerned (original);
  7. Photos : 4 X 6 CM   (colors, with red background)
FAMILY WIFE & CHILDREN (NON WORKER):
  1. Record of valid passport for at least 18 months in full pages;
  2. Record of marriage certificate (wife/husband);
  3. Record of birth certificate or family register (child);
  4. Photos : 4 X 6 CM =   (colors, with red background)
COMPANY:
  1. Deed of establishment of limited liability company (AktePendirian) ;
  2. IP PMA Principle License / IUT / SIUP ;
  3. Minister of Justice & Human Rights for the Company’s approval / MoJ;
  4. Tax payer number (NPWP);
  5. Business registration certificate / TandaDaftar Perusahaan / TDP;
  6. Record of company’s domicile ;
  7. Record of manpower report;
  8. Record of manpower BPJS:
  9. Record of valid identity card or passport of Director;
  10. Power of attorney if done by agent (Proxy);
  11. 2 (two) Identity card of local employees as counterparts for expatriate manpower and their letters of appointment;
  12. Company organization structure/chart (with original company stamp);
  13. Record of employment Agreement between the company and the expatriate;
  14. Record of slip payment of Expatriate and skill Development fund (DPKK): USD 1,200 per worker/year  to be attached for process IMTA (work permit application).
